Evidence Required for SQE2 Exemption Applications

Are you a foreign-qualified lawyer aiming to qualify as a solicitor in England and Wales? If you possess significant legal experience, you may be eligible for an exemption from the Solicitors Qualifying Examination (SQE) stage 2. However, the path to securing an SQE2 exemption requires comprehensive evidence and documentation. Here’s what you need to know to submit a strong application.

What Is an SQE2 Exemption?

The SQE2 tests practical legal skills, including client interviews, advocacy, case analysis, and legal drafting. To be granted an SQE2 exemption, your qualifications and/or work experience must meet the content and standard of SQE2 and align with level three of the SRA Threshold Standard—the competency level of a newly qualified solicitor in England and Wales.

It’s important to note that partial exemptions are not available. You must demonstrate that you meet the requirements for the entire SQE2 examination.

Evidence Required for SQE2 Exemption Applications

To apply for an exemption, you need to provide detailed evidence that shows your qualifications and experience meet the required standards. Your application must include:

  • Qualification Documents

Certificates and transcripts from relevant qualifications, such as your law degree or any post-graduate legal training. Make sure you submit copies of graduation degree certificates, law degree certificates, mark sheets etc.

  • Work Experience

Your legal work experience must be corroborated by detailed reference letters from your supervisors. These references are critical in demonstrating that your work experience aligns with the SRA’s standards.

  • SRA Exemption Form

The SRA exemption form is to be duly filled and attached with the application while making the application.

The Role of Reference Letters

Reference Letter Requirements:

  • Must be written specifically for your SQE2 exemption application.
  • Dated within the last three months.
  • Submitted on official letterheaded paper.
  • Provided for each period of legal experience you are claiming.

Your Supervisor Should:

  • Confirm the dates of supervision and the total hours you worked per week.
  • Provide detailed information about your role, the quality of your work, and the supervision arrangements in place.
  • Include their own legal qualifications:
    • If your supervisor is regulated by the SRA, they must include their SRA number.
    • If they are not regulated by the SRA, they must provide one of the following:
      • Certificate of good standing
      • Admissions certificate
      • A letter from a law society or bar association confirming their qualification in their jurisdiction.

Important: Supervisors must read your SQE2 exemption application in full, review all supporting evidence, and confirm in their reference that they have done so.

Final Tips: Strengthening Your Application

  1. Submit Comprehensive Evidence
Ensure that your application is thorough and includes all relevant qualifications, work experience, and work samples. The more evidence you provide, the better the SRA can assess whether you meet the SQE2 standards.

  2. Work Closely with Your Supervisor
Since your supervisor’s reference is essential to your application, make sure they understand what is required and have reviewed your materials in detail. Their reference should not just confirm your employment dates but also include in-depth insights into your professional skills and competencies.

  3. Attention to Detail
A strong application is one that is accurate, complete, and meticulously detailed. Pay close attention to the SRA’s requirements and ensure all your documents are properly organised and submitted in the correct format.
